Terms and Conditions

of ITA Business GmbH, Landhausstraße 19, 70825 Korntal-Münchingen, Germany (hereinafter "SMSH" or "we")

§ 1 Scope

These Terms and Conditions apply to all orders you place through our online shop at smsh-padel.com. By placing an order, you accept these Terms and Conditions. The version valid at the time of the order applies.

§ 2 Contracting Party

§ 3 Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. By submitting your order, you make a binding offer to purchase. The order confirmation by email constitutes acceptance of your offer. The contract is concluded upon receipt of the order confirmation.

§ 4 Prices and Payment

All prices stated are final prices in euros (€) including statutory VAT. Shipping costs are shown separately and are visible before the order is completed.

The following payment methods are available to you: credit card, PayPal, Klarna, Apple Pay, Google Pay.

Payment is due upon completion of the order.

§ 5 Shipping and Delivery

Shipping takes place from Germany. The expected delivery times are:

• DACH region (Germany, Austria, Switzerland): 2–3 business days
• Rest of Europe: 3–5 business days
• International: 5–10 business days

Shipping costs are:

• Germany: free shipping from €100, otherwise €6.00
• Europe: free shipping from €100, otherwise €10.00
• International: €20.00

Should delivery be delayed, we will inform you by email.

§ 6 Right of Withdrawal

Our separate withdrawal instructions apply. You have the right to withdraw from the contract within 14 days without giving any reason. You can find the details in our withdrawal instructions.

§ 7 Returns and Condition of the Goods

The goods must be returned in their original packaging, unused and without signs of use. The eyewear must be in its original condition — including the hard case, microfiber pouch and cleaning cloth. The customer bears the cost of the return.

In the case of defects or faults in the product, you are entitled to an exchange or refund within 30 days of receipt. Contact us at support@smsh-padel.com.

§ 8 Warranty

The statutory warranty rights apply. The warranty period is 2 years from receipt of the goods. Should a defect occur, contact us at support@smsh-padel.com with a short description — we'll find a solution.

§ 9 Liability

We are liable without limitation for intent and gross negligence. In the case of slight negligence, we are liable only for the breach of essential contractual obligations and limited to the foreseeable damage typical for this type of contract. Liability for damage resulting from injury to life, body or health remains unaffected.

§ 10 Retention of Title

The delivered goods remain our property until full payment has been made.

§ 11 Data Protection

Information on the processing of your personal data can be found in our Privacy Policy at smsh-padel.com.

§ 12 Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
